Terms of Service

A. Service Description

LOTHIANSPOS is a Software-as-a-Service (SaaS) subscription platform that provides cloud-based point-of-sale and business management tools. The service is accessed through web browsers and mobile devices, with all data hosted on Firebase cloud infrastructure.

The platform enables businesses to manage sales transactions, inventory, customer relationships, and business operations through a unified, cloud-based interface.

B. Subscription & Billing

Monthly Recurring Billing

Subscriptions are billed on a monthly recurring basis. Payment is charged upfront at the beginning of each billing cycle.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled by the user before the renewal date.

Free Trial

A free trial period may be available for new users. During the trial period, no charges are applied. If the trial is not cancelled before it ends, the subscription will automatically convert to a paid plan.

Grace Period

If a payment fails, a grace period may be provided during which service access is temporarily retained. If payment is not resolved within the grace period window, service access will be revoked until payment is successfully processed.

Plan Changes

No upgrades or downgrades are permitted during an active paid billing period. Plan changes will take effect at the start of the next billing cycle.

Lifetime Licenses

No lifetime licenses are offered. All subscriptions are recurring monthly subscriptions.

C. Free Trial

The free trial duration is defined at the time of account creation. During the trial period, no charges are applied to your payment method. If you do not cancel your subscription before the trial ends, your account will automatically convert to a paid subscription plan and billing will commence.

D. Grace Period

In the event of a failed payment, a grace period may be provided to allow you time to update your payment method. During this grace period, you will retain temporary access to the service. If payment is not successfully processed within the grace period window, service access will be revoked until payment is resolved.

E. Refund Policy

No refunds are provided after subscription activation. Once service access begins, all sales are final. This policy applies to all subscription plans and billing cycles.

If you are not satisfied with the service, you may cancel your subscription at any time. Your access will continue until the end of your current billing period.

F. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will not renew at the end of the current billing cycle. Your service will remain active until the end of the billing period for which you have already paid.

Cancellation does not entitle you to a refund for any unused portion of the current billing period.

G. User Responsibilities

You are responsible for:

  • Account Security: Maintaining the confidentiality of your account credentials and ensuring that your account is not accessed by unauthorized parties.
  • Lawful Use: Using the service only for lawful business purposes and in compliance with all applicable laws and regulations.
  • No Misuse: Not using the platform to engage in any fraudulent, illegal, or harmful activities.
  • Data Accuracy: Ensuring that all information provided to the platform is accurate and up-to-date.

H. Data & Storage

Your business data is stored on Firebase cloud infrastructure, enabling secure, cross-device access and real-time synchronization. This cloud-based approach ensures that your data is accessible from any authorized device.

Payment Information: The merchant does not store full card numbers. Payment processing is handled through PowerTranz, a PCI DSS compliant payment processor. Tokenization is used for recurring billing, ensuring that sensitive payment information is never stored on our systems.

I. Limitation of Liability

The service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free access to the service. While we strive to maintain high availability, we are not liable for any service interruptions, data loss, or other issues that may arise.

To the maximum extent permitted by law, our liability is limited to the amount paid by you for the service in the twelve (12) months preceding the claim.

J. Governing Law

These Terms of Service are governed by the laws of Jamaica. Any disputes arising from or relating to these terms or the service shall be subject to the exclusive jurisdiction of the courts of Jamaica.
